COWHILL, LLC DBA NUVANIA
Childcare Waiver, Release, and Parent/Guardian Consent
Please read carefully. This agreement concerns short-term childcare provided while a child's parent or
legal guardian remains on Nuvania's premises. By signing or electronically accepting this agreement, I
acknowledge and agree to the following for myself and for the child identified below:
1. Authority and Accurate Information
I represent that I am the child's parent or legal guardian, or that I otherwise have legal authority to enroll the child and
make the decisions described in this agreement. I will provide accurate and complete information about the child's age,
health, allergies, medications, developmental or behavioral needs, emergency contacts, and authorized pickup persons,
and I will promptly update that information if it changes.
2. Short-Term, Onsite Care
I understand that Nuvania's childcare is short-term supervision associated with my use of Nuvania and is not medical
care, individualized therapeutic care, or a substitute for a school or full-day childcare program. I will remain on
Nuvania's premises, remain reachable by phone, and return to the childcare area immediately when requested. A child's
care may not exceed three hours in any twenty-four-hour period.
3. Health and Participation
I will not place the child in care when the child is ill, contagious, or unable to participate safely. I understand that staff
may decline or end care when they reasonably believe the child is ill, presents a safety concern, requires support beyond
what Nuvania can provide, or cannot be safely supervised in the group setting. I will immediately retrieve the child when
asked.
4. Allergies, Medical Needs, and Medication
I will disclose all known allergies, dietary restrictions, medical conditions, mobility limitations, and emergency needs
before check-in. I understand that a group childcare area cannot be guaranteed to be free of allergens or communicable
illness. Unless Nuvania has separately agreed in writing and applicable law permits, staff will not administer
prescription or nonprescription medication.
5. Acknowledgment and Assumption of Risk
I understand that childcare and play involve inherent risks, including slips, trips, falls, collisions, cuts, bruises, strains,
choking, allergic reactions, contact with toys or equipment, contact with other children, bites or scratches, emotional
distress, toileting accidents, and exposure to communicable illness. Serious injury, medical emergency, or other harm is
possible even when reasonable care is used. I voluntarily allow the child to participate and knowingly assume these
inherent risks.
6. Child Conduct and Personal Property
I will explain applicable rules to the child and understand that care may be ended for unsafe, disruptive, aggressive, or
persistently unmanageable behavior. I am responsible for damage caused by the child's intentional misconduct to the
extent permitted by law. Nuvania is not responsible for loss of or damage to toys, clothing, electronic devices, or other
personal property brought into the childcare area, except to the extent liability cannot lawfully be waived.
7. Authorized Pickup
The child may be released only to me or to a person I have authorized in writing or through Nuvania's approved system.
Nuvania may require government-issued identification and may refuse release when identity or authorization cannot be
verified.
Page 18. Emergency Care Authorization
If the child becomes ill or injured, I authorize Nuvania to provide reasonable first aid, contact emergency services, and
obtain emergency medical assistance when staff reasonably believe it is necessary. Nuvania will attempt to contact me,
but emergency action need not be delayed when prompt care appears necessary. I accept responsibility for resulting
medical, ambulance, and transportation charges.
9. Release of Claims, Including Claims of the Child
To the fullest extent permitted by Colorado law, and on behalf of myself and the child, I expressly waive, release, and
agree not to sue Cowhill, LLC dba Nuvania and its owners, managers, employees, childcare staff, agents, independent
contractors, and facility lessors (collectively, the "Released Parties") for claims arising from the child's participation in
or presence at Nuvania childcare, including prospective claims caused by the ordinary negligence of a Released Party.
I understand the nature and extent of the risks described in this agreement, including the potential for minor injury,
serious injury, illness, medical emergency, or other harm, and I make this decision voluntarily and on an informed basis.
This agreement does not release claims that cannot lawfully be waived, including claims based on a willful and wanton
act or omission, a reckless act or omission, or gross negligence. It does not waive any nonwaivable statutory or
regulatory duty.
10. Indemnification
I agree to indemnify and hold harmless the Released Parties from third-party claims caused by my own actions or by the
child's intentional misconduct, to the fullest extent permitted by law.
11. Policies, Governing Law, and Severability
I agree to follow Nuvania's childcare check-in, health, behavior, emergency, and pickup policies as communicated or
posted. This agreement is governed by Colorado law, and any dispute will be resolved in the courts of Boulder County.
If any provision is found unenforceable, the remainder remains in effect.
12. Parent/Guardian Affirmation
